Oigusteooriad, or theories of rights, explore the philosophical underpinnings and justification for the existence and nature of rights. These theories attempt to answer fundamental questions such as what a right is, where rights come from, and why they are important. Different theoretical frameworks offer distinct perspectives on these issues.

One prominent category of theories is natural rights theory, which posits that rights are inherent to human beings and exist independently of any government or legal system. These rights are often considered universal and inalienable. Thinkers like John Locke have argued that natural rights, such as the rights to life, liberty, and property, are endowed by nature or a divine creator.

In contrast, legal positivism focuses on rights as creations of law. According to this view, a right exists only if it is recognized and enforced by a legal system. Rights are thus contingent upon positive law and can vary across different jurisdictions and time periods. Legal positivism emphasizes the social and political construction of rights.

Another significant approach is the interest theory of rights. This perspective suggests that rights protect certain interests that are deemed important enough to warrant legal or moral protection. A right holder is someone whose interests are being safeguarded by the existence of a duty imposed on others.

The will theory of rights, on the other hand, emphasizes the element of control or choice that a right holder possesses. It argues that a right is a form of control that the law grants to an individual over another person's duty. This control allows the right holder to choose whether or not to enforce the corresponding duty. These different theories offer varied explanations for the moral and legal significance of rights, shaping our understanding of justice and individual entitlements.
