Üürilepinguga

Üürilepinguga is the arrangement created by entering into a rental agreement (üürileping) between a landlord (üürileandja) and a tenant (üürnik) for the use of a dwelling or other premises in exchange for rent. It can cover residential or commercial space and may be fixed-term or open-ended. While some contracts can be oral, written agreements are strongly recommended to clarify terms and prevent disputes.

A typical üürilepinguga contains: description of the property; names and contact details of the parties; rent amount and payment due date; security deposit (tagatis); duration and termination/renewal rules; maintenance and repair responsibilities; allowed uses and restrictions; rules on subletting and alterations; responsibility for utilities and service charges; and conditions for returning the premises, including handover of keys and an inventory list.

Rights and obligations within the agreement locally shared by both sides include the landlord’s duty to provide lawful occupancy and to perform essential repairs, and the tenant’s duty to pay rent on time and keep the premises in reasonably good condition. The deposit may be used to cover unpaid rent or damages beyond normal wear. Subletting generally requires the landlord’s consent, and terminations must follow the notice periods stipulated in the contract or by applicable law. The tenancy continues until the termination date or renewal.

Termination and disputes may arise at expiry, upon breach, or by mutual agreement. Notice periods and procedures are defined in the contract or by law, and disputes are typically resolved through negotiation, mediation, or the courts, with eviction following statutory procedures. Practical tips include using a written contract, conducting a move-in inventory, and keeping records of payments and communications.
