Süütevastutus, often translated as "culpability" or "fault liability" in English legal contexts, refers to a legal principle where liability for an act or omission arises from the actor's blameworthy conduct. This means that a person is held responsible not simply because they caused harm, but because they did so negligently, intentionally, or recklessly. In essence, it focuses on the mental state of the perpetrator.

This principle is a cornerstone of criminal law, where intent (mens rea) is a crucial element in proving guilt. For example, to convict someone of theft, the prosecution must demonstrate that the person intended to permanently deprive the owner of their property. Similarly, in tort law, negligence, a form of blameworthy conduct, is a common basis for establishing liability. A defendant is liable if they failed to exercise the care that a reasonable person would have exercised in similar circumstances, and this failure caused harm.

Süütevastutus stands in contrast to strict liability, where liability can be imposed regardless of fault. In strict liability cases, the mere fact that a certain act occurred or a certain harm resulted is enough to establish responsibility, without the need to prove any blameworthy mental state. For instance, engaging in inherently dangerous activities may result in strict liability for any resulting harm.
