Skyldvurdering is a legal term used primarily in Danish and other Nordic languages to describe the assessment of criminal guilt. It refers to the process by which a court or prosecutor determines whether the defendant is legally responsible for the alleged offense.

The assessment focuses on whether the facts satisfy the elements of the charged crime, including both the conduct (actus reus) and the required mental state (mens rea), such as intention, knowledge, recklessness, or negligence. The standard of proof is typically high, commonly described as proving guilt beyond a reasonable doubt. Factors that can influence culpability include the defendant’s age, capacity, mental health, intoxication, duress, or other mitigating or aggravating circumstances.

Procedure and consequences are central to skyldvurdering. During a trial, evidence is evaluated by the judge or a panel, sometimes with a jury, to determine if the elements are proven. If guilt is established, sentencing follows; if not, the defendant is acquitted.
