Indigenous rights are the civil, political, economic, social, and cultural rights claimed by Indigenous peoples, defined by their distinct cultures, identities, and relationships to land and resources. They include the right to self-determination, autonomy or governance within or independent of states, and participation in decisions affecting their communities. Rights are both individual and collective: individuals have rights to culture, language, health, and education; communities have rights to land, resources, and cultural heritage.

International law recognizes Indigenous rights through instruments such as the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP, 2007) and the International Labour Organization Convention 169 (1989). UNDRIP recognizes the rights to self-determination, free, prior and informed consent (FPIC) for projects affecting Indigenous lands, preservation of cultures and languages, and the right to improvement of living conditions while respecting traditional laws. ILO 169 obligates states to consult with Indigenous peoples and obtain consent on matters affecting them. National constitutions and laws vary widely in recognizing these rights.

Land and resource rights are central, as many Indigenous communities link cultural survival to traditional territories. Cultural rights cover language preservation, education, religious and ceremonial practices, and the protection of cultural heritage and traditional knowledge. Implementation challenges include inadequate recognition, overlapping jurisdictions, development pressures, and unequal access to justice. Critics point to the gap between formal recognition and effective protection, while proponents emphasize the potential for empowered Indigenous governance and sustainable natural-resource management.
