Büntethetőség refers to the legal capacity of an individual to be held criminally responsible for their actions in Hungarian law. It is a fundamental concept in criminal law that determines whether a person can be subjected to criminal proceedings and, if found guilty, to punishment.

Several factors influence büntethetőség. Age is a primary consideration. Generally, individuals must reach a certain age to be considered capable of understanding the wrongfulness of their actions and acting accordingly. This age is typically 14 years in Hungary. Before this age, individuals are presumed to lack the necessary mental capacity for criminal responsibility.

Mental state is another crucial element. A person must be of sound mind to be deemed büntethető. If an individual suffers from a severe mental illness, intellectual disability, or other mental disorder that significantly impairs their ability to understand the nature and consequences of their conduct or to control their behavior, they may not be considered büntethető. This assessment is usually made by qualified medical professionals and considered by the court.

Furthermore, the absence of certain defenses that negate criminal responsibility can also be a prerequisite for büntethetőség. These defenses might include actions taken in self-defense, necessity, or duress, provided they meet the strict legal criteria. If such a defense is successfully argued, the individual may not be considered büntethető, even if they committed an act that would otherwise be a crime.
