Yhteisliitännälle

Yhteisliitännälle, often translated as "joint tenancy" in English-speaking legal contexts, refers to a form of property ownership where two or more individuals hold an undivided interest in a property. This means that each owner possesses the entire property, not just a specific portion of it. The key characteristic of yhteisliitännälle is the right of survivorship. If one of the joint tenants dies, their share of the property automatically passes to the surviving joint tenant(s) without the need for probate. This is a crucial distinction from other forms of co-ownership.

The creation of a joint tenancy typically requires four unities: unity of possession, unity of interest, unity of title, and unity of time. Unity of possession means all joint tenants have the right to possess the entire property. Unity of interest signifies that all joint tenants must have identical interests in the property, such as equal ownership shares. Unity of title dictates that all joint tenants must acquire their interest from the same document or act. Finally, unity of time requires that all joint tenants acquire their interest at the same time.

Yhteisliitännälle is a common arrangement for married couples or close family members who wish to ensure that their property passes seamlessly to the surviving partner or relative upon their death. It can simplify the transfer of property and avoid potential disputes among heirs. However, it's important to note that a joint tenant can sever the joint tenancy, thereby eliminating the right of survivorship for their share, by selling or transferring their interest to another party.
