Vårdnadshavaren

Vårdnadshavaren is a Swedish legal term referring to a person who has legal custody of a child. This custody entails the responsibility for the child's upbringing, care, education, and personal development. In Sweden, a child is typically under the care of one or two vårdnadshavare. If the parents are married, they are usually joint vårdnadshavare. If they are not married, the mother is automatically the vårdnadshavare unless otherwise decided by a court or agreement.

The responsibilities of a vårdnadshavare are extensive. They include ensuring the child has a safe environment, receives adequate food and clothing, and has access to healthcare and education. The vårdnadshavare also has the right to make decisions regarding the child's upbringing, such as religious instruction or leisure activities. Importantly, the vårdnadshavare has a duty to protect the child from harm and to ensure their well-being.

Custody arrangements can be sole or joint. In joint custody, both vårdnadshavare share the rights and responsibilities. If parents separate or divorce, they can agree on a custody arrangement, or a court can decide if an agreement cannot be reached. This decision is always made with the child's best interests as the primary consideration. Changes to custody can be applied for if circumstances change significantly.
