Verfassungsauftrag
Verfassungsauftrag is a German term describing the constitutional mandate or mission that the constitution imposes on the state’s organs to preserve and implement the constitutional order. It expresses the idea that all state power derives from the people and must be exercised under the rule of law and in respect for fundamental rights. The concept applies to institutions such as the parliament (the Bundestag), the executive, the judiciary, and the Länder, which are bound by the Basic Law (Grundgesetz) and can be reviewed by the Federal Constitutional Court if their actions threaten the constitutional order.
