Verfahrenspartei

Verfahrenspartei is a legal term used in German law to denote a person or entity that participates directly in a legal procedure before a court or other authority and has procedural rights and obligations arising from the process. Typically, Verfahrensparteien are natural persons, legal entities or associations that have an interest in the dispute or are named as parties to the case.

The term is used in civil, administrative and, in a broader sense, criminal procedure. In civil proceedings the rights and duties of Verfahrensparteien are defined primarily by the Zivilprozessordnung (ZPO); in administrative matters by the Verwaltungsverfahrensgesetz (VwVfG) and the Verwaltungsgerichtsordnung (VwGO) as applicable. The exact scope of who qualifies as a Verfahrenspartei can vary with the legal context and the specific procedural rules.

Verfahrenspartei differs from other participants in the process (Verfahrensbeteiligte) such as witnesses, experts or Beigeladene (intervening parties). A Verfahrenspartei has the right to plead, submit evidence, participate in hearings, and appeal decisions; it also bears responsibilities to comply with procedural requirements and deadlines. In some cases a party’s capacity may be limited or extended by guardians or court decisions.

Examples include the plaintiff and the defendant in a civil action, or the applicant and the authority in an administrative proceeding; in criminal proceedings the accused and the public prosecutor are Verfahrensparteien. Special situations exist where third parties may be granted standing and become Verfahrensparteien with their own rights and obligations.
