Unterlassungsrecht

Unterlassungsrecht refers to a legal principle that allows an individual or entity to seek a court order to prevent another party from continuing or repeating a specific action. This action is typically one that infringes upon the rights of the claimant. The primary goal of an Unterlassungsanspruch, or a claim for injunctive relief, is to stop ongoing harm and prevent future occurrences.

The basis for an Unterlassungsrecht claim often arises from the violation of various legal rights, including those protected under copyright law, trademark law, patent law, or the general right to personality. For instance, if someone is using another person's copyrighted material without permission, the copyright holder can seek an Unterlassungsanspruch to stop the unauthorized use.
