Täidesaatmise

Täidesaatmise is the Estonian term for enforcement. It refers to the legal process by which court decisions, or other enforceable documents, are implemented. This process ensures that rights and obligations established by legal rulings are actually fulfilled. The primary goal of täidesaatmise is to restore the plaintiff's legal position that was violated.

The enforcement proceedings in Estonia are governed by the Code of Enforcement Procedure. This code outlines the powers and responsibilities of enforcement officers, who are responsible for carrying out the enforcement actions. Enforcement officers are independent officials who act under the supervision of the Ministry of Justice.

Enforcement can be initiated by a creditor, who files an enforcement application with an enforcement officer. The application must be accompanied by an enforceable document, such as a court judgment, a bailiff's order, or a notary's authenticated document. Once the application is accepted, the enforcement officer will take steps to enforce the decision.

These steps can include seizing the debtor's assets, such as bank accounts, real estate, or movable property, and selling them to satisfy the debt. Enforcement officers also have the power to garnish wages, levy taxes, and even impose travel bans on debtors. The specific actions taken depend on the nature of the enforceable document and the circumstances of the case. The process aims to be efficient and effective in achieving compliance with legal decisions.
