Toetsingsautoriteit

The Toetsingsautoriteit (Testing Authority) is an independent Dutch regulatory body established to oversee and ensure compliance with privacy and data protection regulations in the Netherlands. It was created in 2015 following the implementation of the General Data Protection Regulation (GDPR) framework in Dutch law, specifically under the *Wet bescherming persoonsgegevens* (Wbp, Dutch Personal Data Protection Act).

The primary role of the Toetsingsautoriteit is to assess and approve privacy impact assessments (PIAs) for organizations handling large-scale or high-risk data processing activities. Before processing personal data on a large scale, organizations must submit a PIA to the authority for review. The Toetsingsautoriteit evaluates whether the proposed data processing complies with privacy principles, including data minimization, purpose limitation, and individual rights. If approved, the assessment provides legal certainty to the organization, reducing the risk of fines or legal challenges.

The authority operates under the supervision of the Dutch Data Protection Authority (*College Bescherming Persoonsgegevens*), ensuring alignment with broader privacy enforcement efforts. While it does not enforce GDPR directly, its approval process helps organizations demonstrate compliance with Dutch and EU data protection laws. The Toetsingsautoriteit also provides guidance and clarifications on privacy assessments, supporting businesses in navigating complex data protection requirements.
