Possessionem is a Latin term that translates to "possession" in English. In legal contexts, it refers to the state of having physical control over a thing along with the intention to control it. This control can be immediate, as in holding an object, or it can be more indirect, such as owning a house where others reside. Possession is a fundamental concept in property law, as it often forms the basis for establishing ownership rights.

There are different types of possession. Actual possession means direct physical control. Constructive possession means having the legal right and ability to control an item, even if it is not physically on one's person. For example, keys to a locked car represent constructive possession. Further, possession can be considered lawful or unlawful. Lawful possession is acquired through legitimate means, such as purchase or inheritance. Unlawful possession occurs when an item is obtained or held without legal right, like stolen goods.

The distinction between possession and ownership is crucial. Ownership implies legal title to a property, granting a bundle of rights, while possession is merely the factual holding or control. One can possess something without owning it, and conversely, one can own something without possessing it. For instance, a landlord owns an apartment but the tenant possesses it. In some legal systems, prolonged and undisturbed possession can, under certain circumstances like adverse possession, lead to the acquisition of ownership rights.
