Perinnönjakajille

Perinnönjakajille refers to individuals appointed to divide an estate among heirs in Finnish law. This role is typically undertaken by a notary public, a lawyer, or an authorized estate administrator when the heirs cannot agree on the distribution of assets and liabilities left by a deceased person. The process, known as perinnönjako, is a formal legal procedure designed to ensure a fair and legally sound division of the inheritance.

The primary responsibility of a perinnönjakaja is to conduct the estate inventory, assess the value of the deceased's assets, and identify all creditors and debtors. They then draft a distribution proposal, taking into account the deceased's will, if any, and the laws of inheritance. This proposal outlines how the estate will be divided, including specific assets and liabilities allocated to each heir.

Before the distribution can be finalized, the proposal must be presented to all heirs. They have the right to review it and raise any objections. If all heirs agree, the distribution document, known as the perinnönjakokirja, is signed, making the division legally binding. If disagreements persist, the perinnönjakaja attempts to mediate, and if a resolution cannot be reached, the matter may need to be settled through court proceedings. The perinnönjakaja acts as an impartial party, ensuring that the division adheres to legal requirements and respects the rights of all involved parties. Their appointment is crucial for resolving complex or contentious estate matters.
