Nachlässigkeit refers to a failure to exercise the care that a reasonably prudent person would exercise in like circumstances. It is a legal concept that can lead to liability for damages caused by the negligent conduct. In many legal systems, negligence requires proof of four elements: duty, breach, causation, and damages. A duty of care is owed to others, and a breach of that duty occurs when a person acts or fails to act in a way that falls below the expected standard of care.
