Maaseadus

Maaseadus is the Estonian term for land law, the system of rules that govern ownership, use, transfer, and protection of land and related natural resources in Estonia. It covers private and public rights in land, including ownership, long-term leases, usufruct, easements, and other servitudes, as well as planning, environmental protection, and access rights.

The legal framework is supported by administrative practice and institutions. The Estonian Land Board (Maaamet) maintains the official land register (kinnistusraamat) and cadastral data. Real estate transactions are typically conducted through notaries, and registration in the land register is required for transfer of title to take effect. Property rights are enforced by the courts, and planning authorities regulate land use through local and national plans.

Historically, Estonia developed a private-property-based land system in the early 20th century, with major reforms during the interwar period and a transition to market-based ownership after regaining independence in 1991. Since joining the European Union, Estonian land law has been harmonized with EU standards regarding environmental protection, planning, and agricultural policy.

Contemporary issues in Maaseadus include land-use planning, access to agricultural land, environmental sustainability, and balancing private property rights with public interests such as conservation, cultural heritage, and efficient land administration.
