Landesarbeitsgericht

The Landesarbeitsgericht, often abbreviated as LAG, is a state labor court in Germany. It serves as the appellate court for decisions made by the Arbeitsgericht, which are the first instance labor courts. This means that if a party in a labor dispute is unsatisfied with the ruling of an Arbeitsgericht, they can appeal to the Landesarbeitsgericht.

The jurisdiction of the Landesarbeitsgericht covers all of Germany's federal states. Each state has at least one LAG, though larger states may have multiple. The judges at the LAG are professional judges, often with extensive experience in labor law. Their decisions are based on the applicable labor laws of Germany, including the Labor Court Constitution Act (Arbeitsgerichtsgesetz) and the Civil Code (Bürgerliches Gesetzbuch).

The proceedings at the Landesarbeitsgericht are typically divided into chambers, with each chamber usually consisting of three professional judges. The main function of the LAG is to review the factual and legal determinations of the lower Arbeitsgericht. It can uphold, overturn, or modify the original decision, or in some cases, remand the case back to the Arbeitsgericht for further proceedings. Decisions of the Landesarbeitsgericht can, under specific circumstances, be appealed further to the Bundesarbeitsgericht, the Federal Labor Court, which is the highest labor court in Germany. The LAG plays a crucial role in ensuring uniformity and correctness in the application of labor law across its respective state.
