Kustannuksissa

Kustannuksissa is a Finnish legal term used in court decisions to indicate the allocation of costs in a dispute. It is commonly found in judgments to specify which party must bear the costs of the proceedings and related expenses. The concept is part of the broader framework of civil procedure governing how the expenses of litigation are handled.

Costs typically include court fees, attorney or legal fees, expert fees, translations, and other reasonable expenses directly connected to the litigation. The court may award these costs to the prevailing party, partially reimburse them, or, in rare cases, deny costs depending on the circumstances of the case.

In practice, the general rule in Finnish proceedings is that the losing party bears the costs, unless there are reasons to deviate. The court decides the amount and whom the costs are awarded to in the judgment, and the order is enforceable as part of the decision. If the parties settle, or if the court finds that no costs should be awarded, the decree on costs reflects that outcome.

Kustannuksissa is thus a functional shorthand within judgments to express the financial outcome of the litigation beyond the substantive verdict. It helps allocate the financial burden of pursuing or defending a claim and clarifies the responsibility for litigation-related expenses.
