Fogadhatóság

Fogadhatóság refers to the legal concept of capacity or competence in Hungarian law, specifically the ability of an individual to enter into legally binding agreements or perform legal acts. It is a fundamental principle in civil law that determines whether a person can be held responsible for their actions or transactions. In Hungarian legal terminology, the term is derived from the Latin *capacitas*, which translates to capacity or ability.

The concept of fogadhatóság is closely tied to the legal age of majority and mental capacity. Under Hungarian law, individuals are generally considered to have full legal capacity upon reaching the age of eighteen, which is the age of majority in Hungary. Before this age, minors are typically considered legally incapacitated for certain transactions, though they may have limited capacity for specific acts, such as entering into contracts with parental consent.

Mental capacity is another critical factor in determining fogadhatóság. A person may be deemed legally incapacitated if they suffer from a mental disability that prevents them from understanding the nature and consequences of their actions. In such cases, courts may appoint a legal guardian or curator to act on their behalf or supervise their legal transactions. Temporary incapacity, such as during a period of unconsciousness or severe intoxication, may also affect a person’s ability to enter into valid legal agreements.

It helps prevent exploitation and ensures that parties to a contract or legal act possess the necessary mental and legal standing to be bound by their commitments.
