EUStaatshilfe refers to state aid granted by member states of the European Union. This aid can take various forms, including direct subsidies, tax breaks, loan guarantees, or favorable public procurement contracts. The primary objective of EU state aid rules is to prevent member states from distorting competition within the single market by unfairly supporting certain undertakings.

The European Commission is responsible for overseeing state aid and ensuring compliance with EU Treaties. It assesses whether a particular state aid measure is compatible with the internal market. Generally, state aid is prohibited unless it meets specific criteria defined in EU law. These criteria often relate to objectives of common European interest, such as supporting research and development, promoting regional development, protecting the environment, or facilitating the rescue of failing undertakings in exceptional circumstances.

Member states are required to notify the Commission of any planned state aid measures that are not covered by a block exemption regulation. The Commission then investigates the notification and decides whether to approve the aid, approve it with conditions, or open a formal investigation if it has doubts about its compatibility. If a state aid measure is found to be incompatible, the recipient may be required to repay the aid to the member state. The rules aim to create a level playing field for businesses across the EU.
