Crossclaiming
Crossclaiming is a procedural concept in civil litigation in which a party asserts a claim against a co-party within the same lawsuit. Typically, crossclaims occur when a defendant sues a co-defendant or a plaintiff sues a co-plaintiff, rather than going directly against the opposing party in the case. Crossclaims are distinct from counterclaims, which are claims against the opposing party in the same dispute.
The purpose of crossclaiming is to resolve inter-party liability efficiently and to allocate responsibility for damages
Procedure generally involves including the crossclaim in the party’s answer or in a cross-claim pleadings component
Common forms of crossclaims include indemnity, contribution, or subrogation claims, though the relief sought can vary
Jurisdictional issues are typically manageable within the same action, as crossclaims share the court’s jurisdiction, but
