CoEigentümerschaften, also known as joint ownership or co-ownership, refers to a legal status where two or more individuals or entities hold rights to the same property. This can apply to various types of assets, including real estate, vehicles, or intellectual property. In a CoEigentümerschaft, each co-owner possesses a fractional interest in the property, rather than exclusive ownership of a specific part.

There are typically two main forms of CoEigentümerschaft. The first is "Bruchteileigentum" (fractional ownership), where each co-owner has a defined, undivided share of the property. This share is often expressed as a percentage or fraction. For example, two siblings might inherit a house and hold it as Bruchteileigentum, each owning 50% of the entire property. The second form is "Gesamthandseigentum" (joint ownership with right of survivorship), where the property is owned by the co-owners collectively, and upon the death of one co-owner, their interest automatically passes to the surviving co-owner(s) without going through probate.

The rights and responsibilities of co-owners are usually determined by a co-ownership agreement or by applicable law. This can include provisions for managing the property, sharing expenses, and deciding on its sale or disposition. Disputes among co-owners can arise regarding these matters and may require legal intervention or mediation to resolve.
