Aufführungsrechte

Aufführungsrechte, also known as performance rights, are a type of intellectual property right that grants exclusive control over the public performance of a copyrighted work. In essence, they allow the rights holder to authorize or prohibit the playing of their music, the staging of their play, or the projection of their film in public. This public performance can include a wide range of activities, such as playing music in a restaurant, broadcasting a song on the radio, performing a play in a theater, or showing a movie in a cinema.

These rights are typically held by the creator of the work, such as a composer, songwriter, playwright, or filmmaker. However, they are often transferred or licensed to other parties, such as music publishers, performance rights organizations (PROs), or film distributors. PROs, like ASCAP, BMI, and SESAC in the United States, or GEMA in Germany, play a crucial role in managing and collecting performance royalties on behalf of their members. They issue licenses to venues and broadcasters that wish to perform copyrighted music, and then distribute the collected fees to the rights holders.
