Átengedés

Átengedés is the act of transferring rights, claims, or duties from one party to another. In Hungarian law, it refers to reallocating the holder of a right or obligation from the assignor to the assignee, typically through contract, by statutory rule, or by court decision. The concept is used in civil and contract law to reallocate who may demand performance and who is obliged to comply with a duty.

Common forms include the assignment of receivables (követelések átruházása or átengedése), the transfer of contractual rights, and the delegation of authority within organizations. It can also involve the transfer or licensing of use rights to another party. The precise scope and effects depend on the applicable law and the terms of the agreement.

The legal effects usually include that the assignee gains the right to demand performance and may enforce the claim against the debtor. The original holder may be released from certain duties, but this depends on the contract and legal rules, and in many cases the debtor must be notified to bind the new holder. Some rights or obligations cannot be transferred, such as personal performance obligations or those restricted by contract. Form requirements (for example, written form) may apply to certain assignments to be fully enforceable.
