täisõiguslikkuse

Täisõiguslikkuse is an Estonian legal term that translates to "full legal capacity" or "competence" in English. It refers to the ability of a natural person to fully exercise their civil rights and fulfill their obligations. This capacity is generally acquired upon reaching the age of majority, which in Estonia is 18 years old.

An individual with täisõiguslikkus can enter into contracts, own property, make legal decisions, and be held accountable for their actions without the need for a legal guardian or representative. This concept is fundamental to the functioning of a legal system, ensuring that individuals can participate fully and independently in society.

However, there are circumstances where an individual may have their täisõiguslikkus limited or removed. This can occur if a court determines that a person is unable to understand the meaning and consequences of their actions due to mental illness, intellectual disability, or severe addiction. In such cases, a guardian may be appointed to make decisions on behalf of the individual. The process for limiting or removing legal capacity is subject to strict legal procedures and is designed to protect the vulnerable while respecting individual autonomy as much as possible. The restoration of täisõiguslikkus is also possible if the circumstances that led to its limitation are resolved.
