Staatsopvolging, also known as succession of states, is a concept in international law that deals with the transfer of rights and obligations from one state to another. This typically occurs when there is a change in sovereignty over a territory, such as through decolonization, unification of states, or secession. The primary legal instrument governing this area is the Vienna Convention on Succession of States in Respect of Treaties, adopted in 1978.

The core principle of state succession is that the rights and obligations of a predecessor state are transferred to a successor state. However, the extent and nature of this transfer can vary depending on the specific circumstances and the type of obligation. For instance, treaties concerning territorial regimes, such as border agreements or servitudes, generally continue to be binding on the successor state. Other treaties, particularly those of a political or military nature, may not automatically pass.

Decolonization is a significant area where state succession plays a crucial role. The principle of "nemo dat quod non habet" (one cannot give what one does not have) is relevant, meaning a predecessor state cannot transfer more rights or obligations than it possessed.
