Rikosvastuullinen refers to criminal responsibility in Finnish law. It is a core concept that determines whether an individual can be held accountable for committing a crime. For an act to be considered a crime and for an individual to be deemed rikosvastuullinen, two main elements must be present: objective guilt (objektiivinen syyllisyys) and subjective guilt (subjektiivinen syyllisyys).

Objective guilt involves the commission of a prohibited act that causes a prohibited result. This means the individual must have performed an action or omission that directly led to the criminal outcome defined by law. Subjective guilt, on the other hand, concerns the mental state of the perpetrator. This can manifest as intent (tahallisuus) or negligence (tuottamus). Intent implies that the person acted with the conscious aim of committing the crime and achieving its result. Negligence means the person failed to exercise the required degree of care, and this failure led to the criminal outcome, even if it wasn't their direct intention.

Furthermore, Finnish law considers various factors that can affect or negate criminal responsibility. These include age, as individuals below a certain age are presumed incapable of forming criminal intent. Mental capacity is also crucial; severe mental illness or impairment at the time of the offense can lead to a finding of non-responsibility. Defenses such as self-defense (hätävarjelu) or necessity (pakkotila) can also negate rikosvastuullinen if the actions taken were justified under the circumstances. The determination of rikosvastuullinen is a fundamental aspect of the criminal justice process, ensuring that punishment is only imposed when an individual has acted unlawfully and with the requisite mental state.
