Pärimismenetlus refers to the legal process of transferring an estate from a deceased person to their heirs in Estonian law. This process is initiated after the death of an individual and aims to identify the rightful beneficiaries of the deceased's assets and liabilities. The proceedings are generally handled by a notary.

The procedure typically begins with the heirs submitting an application to the notary's office where the deceased resided or where their immovable property is located. This application must include details about the deceased, the applicant, and the known heirs. Documents such as the death certificate, proof of kinship (e.g., marriage or birth certificates), and a list of the deceased's property are usually required.

The notary then opens the pärimismenetlus and notifies all known heirs. This notification process ensures that all potential beneficiaries are aware of the proceedings and have an opportunity to assert their rights. During this phase, the notary verifies the validity of the inheritance claims and inventories the deceased's estate. This includes both assets, such as real estate, bank accounts, and personal belongings, and liabilities, such as debts and taxes.

Once the notary has gathered all necessary information and confirmed the heirs, they issue a certificate of inheritance (pärimistunnistus). This document legally confirms who the heirs are and what portion of the estate they are entitled to. This certificate is crucial for the subsequent transfer of ownership of the inherited assets.
