This right is distinct from the right to erasure (right to be forgotten) and is based on the principle that individuals should have control over how their data is used.

The right to object is typically invoked when the processing of personal data is based on legitimate interests of the data controller or is carried out for direct marketing purposes. In the case of direct marketing, the objection must be honored by the data controller without any further justification. For other processing activities based on legitimate interests, the data controller must demonstrate compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the individual. If such grounds cannot be demonstrated, the processing must cease.

The GDPR outlines specific conditions under which an individual can raise a privacybezwaar. These conditions are designed to balance the rights of individuals with the legitimate needs of organizations to process data. The objection must be made in writing and should clearly state the grounds for the objection. Data controllers are then required to respond to the objection within a specified timeframe, usually one month. This mechanism empowers individuals to protect their personal data and ensure it is not processed in ways they deem inappropriate or harmful.
