käyttöomistajille

Käyttöomistaja is a Finnish term that translates to "usufructuary" or "holder of beneficial use" in English. It refers to a legal right where a person or entity is granted the right to use and enjoy the benefits of a property or asset, while the ownership of that property or asset remains with another party. This arrangement is common in inheritance law and in certain property transactions.

The rights of a käyttöomistaja typically include the ability to live in a property, cultivate land, or derive income from an asset. However, these rights are usually limited by the terms of the agreement or will that established the käyttöomistus. The käyttöomistaja generally does not have the right to sell, mortgage, or fundamentally alter the property without the owner's consent. The owner retains the ultimate title and responsibility for the property's upkeep in some cases.

This concept differs from outright ownership, where the owner has full control and disposition rights over the asset. Käyttöomistus often arises when a surviving spouse is granted the right to live in the family home for their lifetime, even if the home is bequeathed to children upon the spouse's death. It can also be used to ensure that an asset is maintained and used for a specific purpose by a designated individual or group. The duration of the käyttöomistus is typically defined, either for a specific period or for the lifetime of the käyttöomistaja.
