Krediitõigused, or credit rights, are a fundamental concept in Estonian civil law. They represent a creditor's legal entitlement to demand performance from a debtor. This performance can take various forms, most commonly the payment of a sum of money, but it can also involve the delivery of goods, the provision of services, or refraining from a particular action.

These rights arise from various legal relationships, such as contracts (loan agreements, purchase agreements, service contracts), torts (damages), or unjust enrichment. The existence of a credit right is typically established by a legal basis, which can be a written agreement, a court decision, or a statutory provision.

The object of a credit right is the performance owed by the debtor. This performance must be definite or determinable, lawful, and possible. The creditor has the right to demand that the debtor fulfill their obligation within the agreed-upon timeframe or, if no time is specified, within a reasonable period.

If the debtor fails to perform their obligation, the credit right becomes enforceable. The creditor can then pursue legal remedies to satisfy their claim, which may include seeking damages for breach of contract, initiating enforcement proceedings, or other legal actions available under Estonian law. Understanding credit rights is crucial for all parties involved in economic transactions, ensuring clarity and predictability in their dealings.
