Kombestusõigus, also known as customary law, refers to a body of unwritten rules derived from the customs and practices of a community. Unlike statutory law, which is enacted by legislatures, kombestusõigus emerges organically from societal traditions and accepted behaviors.

The establishment of kombestusõigus requires several key elements. First, there must be a consistent and long-standing practice. This practice should be widespread within the relevant community. Second, there must be a belief among the members of that community that the practice is legally obligatory, not merely a matter of social convention. This element is often referred to as opinio juris sive necessitatis.

In many jurisdictions, customary law continues to coexist with written law, particularly in areas such as inheritance, land tenure, and family matters, especially in indigenous or tribal communities.
