Kindlustusnõue is a claim made by a policyholder or a beneficiary to an insurer for payment of losses or benefits under an insurance contract following an insured event. The claim arises when the event is covered by the policy and the insured seeks compensation, restitution, or other contractual benefits.

The scope of a kindlustusnõue includes a variety of insurance lines, such as property, liability, life, health, motor, and travel insurance. The claimant may be the insured person or a beneficiary named in the policy, or someone with a right to the benefits under the contract. The exact rights and obligations are determined by the terms of the insurance contract and applicable law.

To initiate a claim, the claimant must notify the insurer promptly and provide the information and documentation required by the policy. Typical evidence includes the policy documents, proof of loss or damage, repair or medical estimates, invoices, and, where relevant, police or incident reports. The insurer examines the claim, assesses whether the loss falls within coverage, applies any limits or deductibles, and determines the amount of compensation. The insurer may request additional information or documents during the investigation and may pay, partially pay, or deny the claim, providing a rationale for the decision.

If the claim is denied or the payout is disputed, the claimant can use the insurer’s internal complaints procedure. If the dispute remains unresolved, it can be directed to appropriate external remedies, such as the Financial Supervisory Authority (Finantsinspektsioon) or pursued in court, and, where applicable, consumer dispute resolution mechanisms.

Kindlustusnõue reflects the contractual obligation of the insurer to honor covered losses and the insured’s responsibility to present a complete and accurate claim. Common issues include disputes over coverage scope, damage valuation, and policy exclusions.
