Formfreier describes a legal regime in which a contract or legal act does not require a specific form to be valid. It is the opposite of formgebunden or formpflichtig, where the law imposes a particular form, such as writing, notarization, or electronic form. In many civil-law systems, formfreiheit means that contracts can be concluded orally or through conduct and do not need a formal instrument to be effective.

In practice, formfrei contracts are common in everyday private law. Most agreements for movable goods, ordinary services, or informal arrangements between private individuals can be created without a written document. Even when a contract is formfrei, standards of evidence still apply, and disputes may be resolved through various forms of proof, including witnesses or conduct. The absence of a required form does not by itself excuse illegal content or unconscionable terms.

Exceptions exist where the law requires a form for validity or enforceability. For example, transactions involving real estate typically require a notarial form, and certain long-term or consumer-finance arrangements may mandate written form to ensure clarity and protection. In such cases, a contract that would otherwise be formfrei becomes invalid or unenforceable unless the prescribed form is observed.

The formfreier concept thus reflects a balance between flexibility in private agreements and the need for formalities in certain high-stakes transactions. It is a feature of civil-law traditions and is contrasted with forms such as Schriftform, Textform, or notarization that impose specific documentation requirements.
