Exploateringsrättigheterna refers to the rights a party acquires to exploit natural resources, typically minerals, within a specified area. In Sweden, this concept is primarily governed by the Minerals Act (Minerallagen). This legislation dictates that the right to exploit minerals found in the ground belongs to the state, but can be granted to individuals or companies through specific permits.

To gain exploateringsrättigheter, an applicant must first secure an exploration permit (undersökningstillstånd). This permit grants the right to investigate the presence of minerals in a designated area. If valuable mineral deposits are discovered and deemed economically viable for extraction, the holder of the exploration permit can then apply for an exploitation permit (koncessionstillstånd). This latter permit grants the exclusive right to mine and extract the identified minerals within the permitted zone.

The process involves detailed applications, environmental impact assessments, and consultations with various authorities and stakeholders, including landowners. Exploateringsrättigheter are time-limited and subject to conditions set by the mining inspectorate.
