Eraõigus, also known as private law, is a branch of law that governs the relationships between private individuals and entities, as distinct from public law which governs the relationship between the state and individuals or between different state bodies. In Estonia, eraõigus is primarily codified in the Civil Code (Tsiviilseadustik). This body of law deals with matters such as contracts, property rights, family law, inheritance, and torts (delicts).

Key principles of eraõigus include autonomy of will, where individuals are largely free to enter into agreements and define their rights and obligations, provided these do not violate mandatory laws or public order. It also emphasizes the principle of good faith in transactions and the protection of legitimate expectations. Eraõigus disputes are typically resolved in civil courts. The areas covered by eraõigus are fundamental to the functioning of a market economy and the everyday lives of individuals, regulating everything from buying a house to marrying and passing on assets.
