Duty bearer is a term used in rights-based approaches to describe an actor who has an obligation to respect, protect, or fulfill the rights of others. Duty bearers can include states and public authorities, but may also encompass private organizations, institutions, and individuals when empowered by law or policy to act on behalf of rights holders. The concept is used to assign accountability for upholding rights within legal and moral norms, and it is often contrasted with rights holders, the people whose rights are the focus of these obligations.

In human rights, development, and disability rights frameworks, duty bearers have duties to refrain from violating rights, to prevent violations by others, and to provide remedies or services when rights are at risk. Common duty bearers include government ministries and agencies, local authorities, public service providers such as hospitals and schools, and private entities that perform public functions or receive public funding. Families and individuals can be duty bearers in contexts of care obligations or social duties.

Obligations of duty bearers typically include: respecting non-discrimination; ensuring access to essential services; creating enabling legal and institutional environments; and providing redress for violations. Accountability mechanisms—courts, ombudsmen, independent commissions, and monitoring bodies—are used to enforce these duties.

Critics note that the scope and enforcement of duties can be uneven across jurisdictions, and identifying the appropriate duty bearer in complex governance arrangements can be challenging. Nevertheless, the duty bearer framework remains a common tool for analyzing responsibility and improving rights protection and service delivery.
