Valitusajan

Valitusajan, in Finnish law, refers to the deadline by which a person must file an appeal against a decision to a higher authority or to a court. The concept governs the right to seek review of administrative decisions and, in many cases, decisions made by state or municipal authorities as well as other bodies whose decisions are subject to appeal.

The starting point and the length of valitusajan are defined in the applicable legislation and often depend on the matter at hand. Typically, the period begins on the date the decision is notified or made available to the party. While many ordinary administrative appeals have a commonly used deadline of 30 days, other acts can set shorter or longer periods. Therefore, the exact deadline is stated in the decision’s appeal instructions or in the relevant statute, such as the Administrative Court Procedure Act or other specific laws.

If an appeal is filed after the deadline, it is usually rejected for being time-barred, unless the law provides for an exception or extension. Extensions may be possible in some circumstances, for example if the delay was caused by factors beyond the appellant’s control or if timely notification could not be ensured.

Different contexts may have distinct procedures and deadlines. Appeals to the Supreme Court, for instance, typically require permission to appeal (valituslupa) and have their own time limits separate from ordinary appeals, as do certain tax or social security decisions that may have special routes.

In practice, those contesting a decision should consult the decision’s valitusohje (appeal instructions) and the relevant act to determine the correct valitusajan.
