Töösuhtestikusse

Töösuhtestikusse refers to the legal and contractual relationship between an employer and an employee in Estonia. This framework defines the rights, obligations, and responsibilities of both parties involved in an employment. The primary source of regulation for this relationship is the Employment Contracts Act (Töölepingu seadus).

Key elements of a töösuhtestikusse include the employment contract itself, which must be in writing and specify terms such as the nature of the work, remuneration, working hours, and place of work. The law outlines mandatory provisions that must be included and prohibits clauses that are less favorable to the employee than those stipulated by law or collective agreements.

The employer has the obligation to provide a safe and healthy working environment, pay wages on time, and respect the employee's personal data. Employees are expected to perform their duties with due care and diligence, follow the employer's lawful instructions, and maintain confidentiality.

Töösuhtestikusse also covers aspects like probation periods, working time and rest periods, annual leave, and protection against unfair dismissal. The termination of an employment relationship is strictly regulated, requiring specific grounds and notice periods, with provisions for compensation in certain situations. This legal structure aims to ensure fair treatment and establish a stable basis for labor relations.
