Täyttöjärjestykseen

Täyttöjärjestykseen refers to a concept in Finnish law and legal practice concerning the order in which obligations are settled when a debtor has multiple debts to the same creditor. This principle is crucial for ensuring fairness and predictability in debt repayment scenarios.

The general rule for täyttöjärjestykseen is that if a debtor pays a sum that is not sufficient to cover all their outstanding debts to a creditor, the payment is first applied to the interest accrued on the oldest debt, then to the principal of that oldest debt, and subsequently to the interest and principal of the next oldest debt, and so on. This order aims to prioritize the settlement of older debts.

However, the parties involved, namely the debtor and the creditor, can agree on a different payment order. This agreement can be explicit, for example, through a contract clause, or it can be implied by the circumstances. If the debtor designates how the payment should be applied at the time of payment, the creditor is generally bound by this designation, provided it does not violate mandatory legal provisions. Conversely, if the debtor does not specify the order, the creditor may have the right to designate how the payment is applied, within the legal framework.
