Tilbudsgiveren

Tilbudsgiveren is the party that submits a bid in response to a procurement process, such as a call for tenders or invitation to tender. The term refers to a person, company, or other entity that offers to supply goods or services under specified terms, including price, delivery time, quality, and technical compliance. The bid represents the bidder’s proposal for fulfilling the contract if selected.

In preparation for bidding, the tilbudsgiveren must demonstrate eligibility and capability. This typically includes corporate information, financial stability, relevant licenses or certifications, and references or evidence of past performance. Bids are usually submitted through a formal process and must meet stated requirements and deadlines. In many jurisdictions, bids are accompanied by documentation such as financial statements, proof of insurance, and technical or quality assurances.

The evaluation of bids is guided by published criteria, which commonly include price, technical quality, delivery terms, sustainability, and the bidder’s experience. The bidder with the best overall score, or the bid that offers the best value for money, is selected for contract award. After award, the tilbudsgiveren enters into a contract and assumes responsibility for fulfilling the terms of the bid, including delivery, performance standards, and compliance with applicable laws and procurement rules. Compliance, performance monitoring, and potential remedies for breaches are part of the post-award phase.
