Termékfelelsség

Termékfelelősség is a Hungarian legal concept that translates to product liability. It refers to the responsibility of a manufacturer or seller for damages caused by defective products. This liability can arise if a product is not manufactured or marketed with the expected level of safety, leading to harm to consumers or their property. The concept aims to protect consumers by holding those who introduce products into the market accountable for any resulting dangers.

In Hungary, product liability is governed by specific legislation, often aligning with broader European Union directives. This means that producers can be held liable for defects in design, manufacturing, or even for inadequate warnings or instructions provided with the product. The burden of proof typically lies with the injured party, who must demonstrate that a defect existed and that this defect caused the damage. However, there are provisions that can shift some of this burden to the producer under certain circumstances.

The purpose of termékfelelősség is twofold. Firstly, it serves as a deterrent, encouraging manufacturers and sellers to prioritize product safety and quality. Secondly, it provides a legal recourse for individuals who have suffered harm due to faulty products, allowing them to seek compensation for their losses. This legal framework is crucial for maintaining consumer confidence and ensuring a safe marketplace for goods and services.
