Tagasivõim

Tagasivõim, often translated as "repurchase option" or "buyback option," is a contractual term primarily found in lease agreements and sometimes in asset sale contracts. It grants the lessee or buyer the right, but not the obligation, to return the leased asset or sold asset to the lessor or seller at a predetermined price or according to a specified formula before the end of the contract term or after a certain period.

This option provides flexibility for the lessee or buyer. For instance, in a lease agreement, a lessee might include a tagasivõim clause to mitigate the risk of technological obsolescence or changing business needs. If the asset becomes less valuable or useful than anticipated, they can exercise the tagasivõim to avoid further rental payments. Conversely, if the asset proves to be highly valuable, the lessee may choose not to exercise the option and continue using it.

The terms of the tagasivõim are crucial and must be clearly defined in the contract. This includes the exercise period, the price at which the asset can be repurchased (often a residual value or a pre-agreed amount), and any conditions that must be met for the option to be valid.
