Täitmisabinõusid

Täitmisabinõusid refers to enforcement measures in Estonian law. These are legal tools used to ensure compliance with court judgments, administrative decisions, or other legal obligations when the obligated party fails to voluntarily fulfill them. The primary purpose of täitmisabinõusid is to achieve the enforcement of a legally established claim.

The enforcement process is typically initiated by a creditor who obtains an enforceable title, such as a court judgment or a notarial deed. This title is then presented to an enforcement officer, known as a täitur. The täitur is a state official or a private person authorized by the state to carry out enforcement actions.

Common types of täitmisabinõusid include seizing movable property, such as vehicles or bank accounts, and selling them to satisfy the debt. Immovable property, like real estate, can also be seized and auctioned. In cases involving monetary obligations, the enforcement officer may order a deduction from the debtor's salary or other income. For non-monetary obligations, such as the return of property or the performance of a specific action, enforcement measures can involve compelling the debtor to act or imposing penalties for non-compliance. The specific measures available and their application depend on the nature of the obligation and the circumstances of the case, always adhering to the principles of proportionality and legality.
