Szerződésmódosítások are amendments or modifications to existing legal contracts. In Hungarian contract law, parties to a contract are generally free to amend its terms by mutual agreement. This allows for flexibility and adaptation to changing circumstances or new understandings between the parties.

A contract amendment typically requires the same form as the original contract, especially if the original contract was subject to specific formalities like being in writing or notarized. For instance, if a contract for the sale of real estate was required to be in writing, any amendment to its terms must also be in writing.

Common reasons for contract modifications include changes in scope of work, price adjustments, revised timelines, or alterations in the rights and obligations of the parties. It is crucial that any amendment clearly identifies the original contract and specifies the exact changes being made. Ambiguity in an amendment can lead to disputes.

If parties cannot reach an agreement on a modification, the original contract remains in effect. In some cases, a contract may contain clauses that outline the process for proposing and agreeing upon amendments, or it might even specify conditions under which certain modifications are permissible or not. Seeking legal advice is often recommended when drafting or agreeing to contract amendments to ensure they are legally sound and reflect the true intentions of the parties.
