Subresiding

Subresiding is a term that describes the practice of living in a property that is not the primary residence of the owner, without the owner's explicit consent. This often occurs when a person rents out a property they are occupying but do not own, and then further rents out that same property to a subtenant. The original owner may or may not be aware of this arrangement. In many jurisdictions, subresiding without proper authorization can be illegal and lead to significant legal consequences for both the sublessor and the subtenant.

The motivations behind subresiding can vary. For the sublessor, it can be a way to generate income from a property they are not legally entitled to rent out, or to cover their own rental costs. For the subtenant, it might be a more affordable housing option or a way to secure accommodation in a difficult rental market. However, the risks are substantial. Subtenants may have limited tenant rights and could face eviction without notice if the original lease is terminated or if the sublessor's activities are discovered. Landlords typically have clauses in their lease agreements that prohibit subletting without permission, and violating these can result in forfeiture of the lease.
