Sovittelumenettelyä

Sovittelumenettelyä, or mediation, is a voluntary process where a neutral third party, the mediator, helps disputing parties reach a mutually acceptable agreement. The mediator does not make decisions for the parties but facilitates communication and negotiation. Mediation can be used in a wide range of disputes, including family matters, workplace conflicts, commercial disagreements, and civil litigation.

The core principle of mediation is self-determination, meaning the parties themselves control the outcome of the dispute. The mediator's role is to guide the conversation, clarify issues, identify underlying interests, and explore potential solutions. Confidentiality is a key element, as discussions during mediation are generally not admissible in court. This encourages open and honest communication.

Mediation offers several advantages. It is typically faster and less expensive than traditional litigation. It also allows parties to maintain control over the resolution and can preserve or even improve relationships. The process is flexible and can be tailored to the specific needs of the parties involved. Agreements reached through mediation are usually binding contracts.

While mediation aims for resolution, it is not always successful. If the parties cannot reach an agreement, they retain the option to pursue other dispute resolution methods, such as arbitration or litigation. However, even if a full agreement is not reached, mediation can sometimes clarify issues or narrow the scope of the dispute.
