Servitudesfor

Servitudesfor is a legal concept pertaining to real property rights. It refers to a legal burden on one piece of land, the servient tenement, for the benefit of another piece of land, the dominant tenement. This burden allows the owner of the dominant tenement to use or restrict the use of the servient tenement in a specific way. Common examples of servitudes include rights of way, where one landowner is permitted to cross another's property to access their own land. Another type is a utility servitude, which allows utility companies to run lines or pipes across private property. Light and air servitudes can prevent a landowner from constructing a building that would obstruct the natural light or air to a neighboring property.

Servitudes can be created in several ways. They may be established by express agreement between landowners, often documented in a deed. Alternatively, they can arise by implication, such as when land is divided and a particular use of one part is necessary for the enjoyment of the other. Prescription is another method, where a right is acquired through long-term, continuous use without permission, but openly and without challenge. Easements are a common form of servitude. The rights and obligations associated with a servitude are typically defined by the terms of its creation and the relevant laws of the jurisdiction. Servitudes "run with the land," meaning they are binding on future owners of both the servient and dominant tenements.
