Sözlemeler

Sözlemeler, in Turkish law, refers to legally binding agreements or contracts. These agreements establish rights and obligations between two or more parties. The fundamental principle behind sözlemeler is mutual consent, where all parties voluntarily enter into the agreement with a clear understanding of its terms. These agreements can cover a wide range of interactions, from simple everyday transactions to complex business deals and employment relationships.

The validity of a sözleme typically depends on several key elements. These include the capacity of the parties to enter into a contract (e.g., being of legal age and sound mind), a clear offer and acceptance of that offer, consideration (something of value exchanged between parties), and a lawful purpose. The terms of the sözleme must be clearly defined, leaving no room for significant ambiguity.

Sözlemeler can be express, meaning their terms are explicitly stated either verbally or in writing, or they can be implied, where the agreement is inferred from the conduct of the parties. Written sözlemeler are generally preferred for clarity and ease of proof, especially for significant agreements like property sales or employment contracts.
